I hereby acknowledge this release from liability for accidental injury or illness which I may incur as a result of participating in any physical activity. I hereby assume all risks connected therewith and consent to participate in the activities. As a participant and/or use of equipment rented from Willamette Tides LLC, I understand and am aware that rafting, tubing, kayaking, and floating the Willamette river are inherently dangerous activities. I understand that the use of tubes, rafts, kayaks, and other flotation equipment involves a risk of injury to any and all parts of the user’s body and possible death. I hereby agree to freely and expressly assume and accept any and all risks in the use of the equipment rented. I agree to expressly indemnify, defend, and hold Willamette Tides LLC, its officers, agents, and employees harmless from and against, any and all liability, expense, loss, injury, or death to passenger, participant, or any person or property, including reasonable attorney’s fees, in instituting or defending any action or proceeding arising from rental of rafting, tubing, kayaking, and/or floating equipment, including, but not limited to, claims for negligence, breech of warranty, contract, claim, or any other legal theory. Willamette Tides LLC assumes no risk of injury to participants, or any liability for the use of equipment.

I will inspect all equipment prior to use to ensure it is in good condition and agree to return equipment in same condition it was issued to me. I authorize Willamette Tides LLC to charge my credit/debit card on file to pay for the replacement value of any lost, stolen, or damaged equipment.

I certify I am at the age of 18 or above and I have read this release of liability and rental agreement and fully understand and agree to its terms. I certify that I, as a parent/guardian with legal responsibility for any participant under the age of 18, consent and agree to all terms within this liability agreement and release from any and all liability incidents to my minor's participation in activities provided by Willamette Tides LLC.
